Terms of Service

These terms are the rules for using Whifflist, an app for ranking the fragrances you've tried. By creating an account or using the app, you agree to them. If you don't agree, please don't use Whifflist. We keep these short and plain on purpose.

The short version

• You must be 13 or older. If you're under 18, a parent or guardian should agree to these terms with you.
• What you post is yours. You let us show it in the app so Whifflist can work.
• Photos must be photos you took yourself, of the fragrance itself. No people, no pictures copied from stores or the internet.
• Be decent. We can remove content and close accounts that break these rules.
• Fragrance information comes partly from users and may be wrong. Test on a small patch of skin first.

1. Who can use Whifflist

You must be at least 13 years old. If you are under 18, you confirm that a parent or guardian has read and agreed to these terms with you. You must give your real birth month and year when asked. One person, one account. Don't use someone else's account or let others use yours.

2. Your account

You are responsible for what happens on your account, so keep your password safe. Your username and name must follow our rules: no profanity, slurs, impersonation, or names that pretend to be Whifflist or a brand. We may change or remove a username that breaks these rules.

3. What you post

"Your content" means anything you add: rankings, ratings, tags, written reviews, your profile, fragrances you add to the catalog, and photos.

You keep ownership of your content. By posting it, you give Whifflist a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, display, and share your content in the app and in material that promotes the app (for example, showing a bottle photo on a fragrance page or in a screenshot), for as long as it is on Whifflist. This license ends when you delete the content or your account, except for copies that other people have already shared, content that is part of combined anonymous statistics, and copies kept in routine backups for a limited time.

Fragrances you add to the catalog (a name, brand, concentration, and scent family) become part of the shared catalog. They may stay in the catalog after you delete your account, without your name attached.

You confirm that you have the right to post your content, and that it doesn't break the law or anyone else's rights.

4. Photo rules

Photos must:

• Be taken by you.
• Show the fragrance bottle, box, or sample vial for the fragrance page you post them on.

Photos must not:

• Show people, including faces, bodies, or anyone's reflection.
• Be copied from a store, a brand, an ad, or another website or app.
• Contain nudity, violence, drugs, weapons, hateful symbols, personal information (such as addresses or phone numbers), or text meant to advertise something.

We may hide or remove any photo, at any time, for any reason, including after reports from other users. Photos that two different people report are hidden automatically until we review them.

5. Community rules

Don't:

• Harass, bully, threaten, or insult anyone.
• Post hateful, sexual, violent, or illegal content.
• Pretend to be someone else, or a brand or store.
• Spam, or use bots, scripts, or other automated ways to use the app or collect data from it.
• Try to break, overload, or get around the app's security, privacy settings, or limits.
• Use Whifflist to sell or advertise things, unless we agree to it in writing.

Reviews must be about the fragrance and your experience of it. Some words are refused automatically.

You can block and report people, reviews, and photos from inside the app. We review reports and may remove content, limit features, or suspend or delete accounts that break these rules, with or without warning.

6. Fragrance information

Fragrance details (notes, families, perfumers, community ratings, predicted ratings, and recommendations) come from public information, from other users, and from our own calculations. They may be incomplete or wrong. They are opinions and estimates, not facts or advice. Fragrances can cause skin reactions or allergies: check the ingredients on the real product and test it on a small patch of skin first.

7. Links to stores and commissions

Some pages link to other websites where you can buy or sample a fragrance. We may earn a commission if you buy something through these links. We don't control those websites and aren't responsible for their products, prices, shipping, or policies. Our recommendations are based on your taste, not on commissions.

8. Our app

Whifflist is provided "as is" and "as available." We are constantly changing and improving it. We may add, change, or remove features, and we may stop offering the app. Test versions (such as TestFlight builds) may have bugs and may lose data.

To the fullest extent the law allows, Whifflist is not liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of the app. Our total liability for any claim about the app is limited to the greater of the amount you paid us in the last 12 months or 50 US dollars. Some places don't allow these limits, so they may not apply to you.

9. Ending your account

You can delete your account at any time in Profile > Delete account. We may suspend or end your account if you break these terms or if we have to by law. Sections 3 (the license that survives), 6, 8, and 10 still apply after your account ends.

10. Disputes

These terms are governed by the laws of the State of California, USA, without regard to its conflict of laws rules. Before filing any claim, please contact us so we can try to resolve it informally.

11. Changes to these terms

If we make important changes, we will update the effective date above and let you know in the app. If you keep using Whifflist after a change, you agree to the new terms.

Our Privacy Policy explains what information we collect and how we use it. You can read it in the app under Profile > Privacy Policy.
